Terms of Service
Last updated August 12, 2026
1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Compute Cheap Inc., 2261 Market Street, San Francisco, CA 94114 ("Compute Cheap", "we"). They govern your access to and use of the Compute Cheap website and GPU capacity reservation service (the "Service"). By submitting a capacity request, signing in to the customer dashboard, or otherwise using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.
2. The service
Compute Cheap operates a request-based reservation model, not a self-serve instant-provisioning marketplace. You submit a capacity request describing the GPU type (H100, H200, or B300; B200 is currently sold out), interruptible capacity, the number of GPU-hours, and your desired start date. We confirm availability before any payment is taken.
Reserved capacity is held for you for the duration of your block. Interruptible capacity is priced lower and may be reclaimed if demand requires it; it is not covered by our uptime SLA.
3. Requests, minimums, and payment
The minimum reservation is 2,000 GPU-hours per request. Submitting a request does not guarantee capacity or create a binding reservation; capacity is confirmed only after we review your request.
Once availability is confirmed, 50% of the block's total price is due upfront to reserve it, and the remaining 50% is billed as usage completes. Prices quoted at confirmation are fixed for the duration of that reservation and do not change while your block is active.
4. Your account and the dashboard
Confirmed customers receive access to a customer dashboard to monitor active reservations. Access is invite-only; there is no public self-service sign-up. You are responsible for keeping your account credentials confidential and for all activity under your account.
5. Acceptable use
You agree not to use the Service to:
- Violate any law, or infringe the rights of any third party.
- Run workloads that generate malicious code, mine cryptocurrency outside of a request explicitly approved for that purpose, or attempt to gain unauthorized access to other systems.
- Resell, sublicense, or provide access to reserved capacity to a third party without our prior written consent.
- Interfere with or attempt to circumvent the security, rate limits, or resource isolation of the Service.
We may suspend or terminate access for a violation of this section, with notice where reasonably possible.
6. Your data and workloads
You retain all rights to the data, models, and workloads you run on reserved capacity ("Customer Data"). We do not access, use, or claim ownership over Customer Data except as needed to operate, secure, and support the Service, or as you direct. See our privacy & security policy for how we handle personal information collected through the website and request forms, which is separate from Customer Data.
7. Service levels and support
Our uptime commitment, service credits, and support response targets for reserved capacity are described in our Uptime SLA, which is incorporated into these Terms by reference.
8. Disclaimer of warranties
Except for the uptime commitment stated in our SLA, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Compute Cheap will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or related to these Terms or the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
10. Termination
You may stop submitting new capacity requests at any time. We may suspend or terminate your access to the dashboard, or decline to confirm a pending request, if you violate these Terms, or with 10 days' notice for any other reason. Fees already due for confirmed, active reservations remain payable.
11. Changes to these terms
We may update these Terms from time to time. If a change is material, we'll notify you by email at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
